STATEMENT

Kevin Weiss, CEO of JMH Weiss, Inc., Civil Engineer, is not an officer of Waters Fund LLC

An article in the February 12, 2007 edition of the San Jose Business Journal erroneously named Kevin Weiss, CEO of JMH Weiss, Inc., as an officer of the Waters Fund, a land acquisition and development company based in Santa Clara, CA.

JMH Weiss, Inc. states that Kevin Weiss is not an officer of the Waters Fund.

JMH Weiss, Inc. was engaged by the Waters Fund to provide professional services in about January 2006. Those services ended in August 2006. JMH Weiss Inc. is currently pursuing legal claims against the Waters Fund for payment owed for services rendered, and other claims.

As of February 12, 2007, the San Jose Business Journal has agreed to clarify its published statements, and affirm that Kevin Weiss, CEO of JMH Weiss, Inc., is not an executive officer with the Waters Fund, as referenced in the February 12, 2007, article by Sharon Simonson.
